Terms of Service

1. Purpose

These Terms of Service (hereinafter "ToS") govern access to and use of the Kolivo mobile application (hereinafter "the Application") and all associated services.

Kolivo is a platform connecting travelers with available space in their luggage and senders wishing to ship packages. Kolivo acts as an intermediary and does not directly provide a transportation service.

2. Acceptance of the ToS

By creating an account or using the Application, you accept these ToS without reservation. If you do not accept these terms, you must not use the Application.

Kolivo reserves the right to modify these ToS at any time. Modifications take effect upon publication in the Application. Continued use of the Application after modification constitutes acceptance of the new ToS.

3. Registration and account

3.1 Registration requirements

• The user must be at least 18 years old.
• Information provided during registration must be accurate, complete and up to date.
• Each person may create only one account.

3.2 Identity verification (KYC)

To use certain features of the Application (publishing a travel, making or receiving a payment), the user must complete an identity verification process (Know Your Customer). This process is mandatory to ensure security and trust between users.

3.3 Account security

The user is responsible for the confidentiality of their login credentials. Any activity carried out from their account is deemed to have been carried out by them. In case of suspicion of unauthorized use, the user must contact us immediately.

4. How the service works

4.1 For travelers

A traveler can publish a trip by indicating:

• Departure and arrival cities.
• Travel dates.
• Available capacity (in kilograms).
• Price per kilogram.

The traveler agrees to transport accepted packages with care and to deliver them to the recipient under the agreed conditions.

4.2 For senders

A sender can search for available travelers and reserve capacity to ship a package. The sender agrees to:

• Accurately describe the contents of the package.
• Comply with restrictions on prohibited items.
• Provide accurate information about the package weight.

5. Prohibited items

It is strictly forbidden to transport via Kolivo:

• Illicit substances or drugs.
• Weapons, ammunition or explosives.
• Dangerous, flammable or toxic materials.
• Counterfeits and goods protected by intellectual property rights.
• Live animals.
• Perishable goods not packaged appropriately.
• Any item whose transport is prohibited by the law of the country of departure, transit or arrival.

Kolivo reserves the right to suspend or delete the account of any user in violation.

6. Payments

6.1 Terms

Payments between senders and travelers are processed by our payment provider Paystack. Payment is made at the time of reservation and held securely until delivery confirmation.

6.2 Commission

Kolivo charges a commission on each transaction for the operation and maintenance of the platform. The amount of the commission is clearly indicated before payment validation.

6.3 Refunds

In case of cancellation by the traveler before the travel date, the sender is fully refunded. Refund conditions may vary depending on the circumstances and will be handled on a case-by-case basis.

7. Liability

7.1 Role of Kolivo

Kolivo is a technology intermediary. We facilitate the connection between travelers and senders but are not party to the agreements concluded between them. Kolivo cannot be held responsible for:

• The contents of transported packages.
• Delays, losses or damages occurring during transport.
• The behavior of users.

7.2 User liability

Each user is responsible for compliance with applicable laws and regulations, particularly with regard to customs and the transport of goods. Users agree to use the Application in good faith and in compliance with these ToS.

8. Intellectual property

The Application, its content (texts, images, logos, source code) and its brand are the exclusive property of Kolivo. Any reproduction, distribution or unauthorized use is prohibited.

9. Account deletion

The user may delete their account at any time from the Application settings (section "My account" > "Delete my account"). Deletion results in:

• The permanent deletion of all personal data.
• The cancellation of all ongoing reservations.
• The impossibility of recovering the account or deleted data.

Kolivo reserves the right to suspend or delete an account in the event of a violation of these ToS, fraudulent behavior or abusive use of the platform.

10. Disputes

In case of dispute between users, Kolivo may intervene as a mediator to facilitate resolution. Users agree to cooperate in good faith in the resolution process.

These ToS are governed by applicable law. Any dispute relating to the interpretation or execution hereof will be submitted to the competent jurisdictions.
